Terms of Service
First-person pronouns (“I,” “my,” etc.) refer to me, Kludge/Kludge’s Art. Second-person pronouns (“you,” “your,” etc.) refer to you, the commissioner.
All commissioners will abide by these terms whether they have read them or not. Commissioners who repeatedly defy my Terms of Service will not be allowed to commission me in the future. I understand the chance of overlooking some information, so at first, I will see to respectfully contacting you if you violate any of my terms.
LAST UPDATED: 12 JUNE 2023
Payment
- I accept payment through Stripe invoices. (It is sent to your email. You do not need a Stripe account to pay.)
- US-based commissioners: pay through ACH direct debit bank transfer
- International commissioners: pay with a credit/debit card
- Work only begins after I receive full/agreed payment. If payment is not sent within 48 hours of billing (without giving me further notice), I might cancel or postpone the commission.
- Refunds are only offered if I feel that I cannot complete the commission. The refund will be calculated based on how much was completed.
- Payment plans are available for commissions priced $150 and above. If you are unable to follow through with a payment plan while the commission is in progress, I will cease production and give you what was completed up to your last payment.
- An interest fee of 10% will be added onto the final cost.
- The minimum payment for each monthly installment will be $100. When the balance is underneath the minimum, the final installment will be the full remainder.
- Anything that is physically shipped to those who live in California will need to have Sales Tax applied to the total. The rate is 8.5% in my city.
- I accept tips through Ko-Fi. Tips are not required, but they’re greatly appreciated if you have extra funds to spare. A Ko-Fi or two really helps with payment processing fees.
Artist
- I reserve the right to refuse a request. I will only draw in my art style, and I reserve the right to make subtle changes as to how I approach my style periodically.
- I prefer drawing anthro animals (furries). People and feral animals aren’t my strong points, but I can still draw them.
- I do not draw copyrighted characters from media (i.e., characters from TV shows, anime, video games) on commission to avoid copyright issues. Characters cosplaying, as well as clothing patterns containing such characters are okay.
- I will not claim your character as my own. However, I reserve the right to use any commission work that I created in my own galleries, portfolio, etc.—this includes creating art in public livestreams and posting work-in-progress shots on my Patreon.
- I do not create artwork to be used as a Non-Fungible-Token (NFT), and I do not consent for my art to be used in AI-generating technologies.
Commissioner
- You must own all characters whom you are commissioning me to draw—or you must get written permission from the owner of whom a character belongs to (I will be a bit lenient if it is a gift for someone close to you).
- You may re-upload and redistribute your commissioned pieces, but you may not claim the original art as your own nor make a profit off of it. Crediting me in reposts is the respectful thing to do, but I do not require it—unless someone directly asks you who the artist is.
- If you would like to use my art in merchandise or other products for purchase, we must have a discussion about it and come to an agreement beforehand.
Edits
- Three free editing sessions can be requested during each stage of the commission. Each stage begins when I send my initial work-in-progress shot (e.g., a sketch is stage one, coloring is the second stage, and shading is the third). Every screenshot after a requested edit counts as one free editing session.
- Correcting incorrect markings and other small fixes fall under these free editing sessions. Larger edits, such as changing the clothes, may incur an additional fee.
- Editing sessions do not stack and reset after each stage is completed. A $10 fee will be charged to get an additional two editing sessions per stage.
- When your commission is complete, you may crop, flip, add a border, and apply a filter yourself without my written permission.
- You may not make nor have anyone else make any other edits to your commission without my permission.
Miscellaneous
- Make sure your visual references are clear and accurate. I may skip over your commission inquiry entirely if this information is unclear.
- If your reference is shaded, please provide two additional reference materials.
- Turnaround times vary.
- You will be given an estimated time period of when to expect an update. If I have an update ready for you, I will message you. Do not ask about progress until after the specified date.
- Rushing me will not make the art get done faster. If you need artwork done by a specific time, you must be upfront with that at the beginning (which may have an additional fee).
- Rest assured that I will never forget about doing your commission. You will be listed on my public Queue until your commission is completed. It is wise to check my social media for any emergency updates in case I suddenly fall silent (I will keep you posted directly if I can).
- Free requests are only for drawing copyrighted characters (from TV shows, games, etc.), unless otherwise specified.
- The availability of free requests may be seen on social media like my Twitter or Tumblr. (Copyrighted characters can be drawn as a Patreon reward.)
